Naturalization and Citizenship
Many immigrants who come to the United States on various types of employment-based visas hope to someday become full-fledged United States citizens, acquiring all the responsibilities and benefits that come with it.
Many employment-based visas can act as a stepping stone to citizenship, but the naturalization process can be complex, with many requirements based on both the amount of time you have resided in the United States and other factors such as good moral character. Our attorneys at Premier Immigration Solutions, PLLC understand these requirements and guide you throughout the process of achieving your dream of becoming a United States citizen.
Permanent Residency
The first step in attaining U.S. citizenship for those who are in the United States on employment-based visas is acquiring permanent residency, commonly known as a Green Card. As one of the requirements of acquiring U.S. citizenship is being a lawful permanent resident for five years, you will need to convert your employment-based visa into a Green Card if you are not already residing in the United States as a permanent resident.
Our attorneys can work with you if you are in the United States on an employment-based visa towards acquiring permanent residency. We will review your eligibility for permanent residency and determine if you are a good candidate. We will help you complete the necessary applications and documentation requirements and deal with USCIS along the way including any requests for additional evidence.
U.S. Citizenship Requirements
Once you have resided in the United States for five years (three years if you are married to a U.S. Citizen), you are eligible to apply for naturalization, however, there are other requirements that must be satisfied. For one, you must have maintained a continuous residence in the United States during this time period, with limited trips abroad and you must demonstrate that you have good moral character. Criminal offenses or certain activities can affect this determination.
Additionally, most applicants will have to show an ability to read, write, and speak basic English, however, some exemptions do exist based on age and length of residency. Applicants will also have to pass a civics test, administered in English, demonstrating knowledge of U.S. government and history. Finally, new citizens are required to take the Oath of Allegiance to the United States.
